By booking a charter or accessing our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.

2. Service Overview

HarborQuietLake offers top-tier yacht charter services, including, but not limited to:

  • Yacht rentals for the day
  • Sunset sailing experiences
  • Executive retreats
  • Exclusive gatherings
  • Extended yacht charters

Service availability is dependent on multiple factors and may change. We hold the right to alter or terminate services without prior notice.

3. Booking and Reservations

3.1 Booking Process

When reserving a charter, you must:

  • Be 18 years or older
  • Provide valid and comprehensive details
  • Submit the required deposit as indicated in your reservation confirmation
  • Accept these Terms & Conditions

3.2 Confirmation

A charter reservation is only secured once we have received your payment and sent a written confirmation. We maintain the right to deny service at our discretion.

3.3 Availability

Yacht availability for charters is contingent upon the vessel's schedule and favorable weather conditions. We will endeavor to meet your requested dates and times whenever possible.

4. Payment Terms

4.1 Pricing

All fees are quoted in € and are inclusive of applicable taxes unless stated otherwise. Fees are subject to change without prior announcement.

4.2 Payment Schedule

  • Deposit: 50% of the total cost of the charter is due at the time of reservation
  • Remaining Balance: Payable 48 hours before the set departure of the charter
  • Incidental expenses (if applicable): Payable at the end of the charter

4.3 Payment Methods

We accept a variety of payment methods including major credit cards, electronic bank transfers, and certified bank drafts. All payments are processed using secure and encrypted frameworks.

5. Cancellation and Refund Policy

5.1 Customer Cancellations

  • With a notice more than 72 hours prior to departure: Full reimbursement minus transaction fees
  • Notice given between 24-72 hours before departure: 50% refund
  • Less than 24 hours notice before departure: No refund possible

5.2 Weather Cancellations

In the instance of unsafe weather conditions as determined by our captain, we will propose to:

  • Reschedule the charter to an alternative date at no additional charge
  • Issue a full refund if rescheduling isn't an option

5.3 Mechanical Issues

Should the designated vessel encounter mechanical issues, we'll attempt to provide an appropriate substitute. If no replacement is available, we will issue a full refund.

6. Safety and Conduct

6.1 Safety Requirements

All guests are required to:

  • Adhere to all directives given by the crew
  • Wear the safety equipment provided when necessary
  • Inform us of any medical conditions that may affect their safety
  • Remain within the designated areas aboard the vessel

6.2 Prohibited Items

Items not allowed on board include:

  • Containers made of glass
  • Illegal substances
  • Weapons or firearms
  • Excess beverages (beyond reasonable consumption)
  • Animals (unless prior approval is granted)

6.3 Conduct

Passengers must behave respectfully. Should passenger behavior result in safety concerns or disrupt other guests' experiences, we reserve the right to terminate the charter prematurely without a refund.

7. Liability and Insurance

7.1 Our Liability

We limit our liability to the charter cost paid. We are not liable for:

  • Injuries caused by passenger negligence
  • The loss or damage of personal belongings
  • Indirect, incidental, or punitive damages
  • Delays due to weather or unforeseeable circumstances outside of our control

7.2 Insurance Coverage

Our operations and vessels are insured under a comprehensive marine insurance policy. You are responsible for your own travel and personal insurance needs.

7.3 Assumption of Risk

Participation in our charter services indicates your understanding that yachting activities carry inherent risks, and you voluntarily assume responsibility for your own safety and welfare.

8. Modifications and Itinerary Changes

Itinerary alterations, as well as changes to routes or schedules, may occur due to weather, safety, or operational needs. We will make every attempt to offer suitable alternative arrangements.

9. Force Majeure

We are not accountable for setbacks, alterations, or cancellations resulting from factors beyond our control, such as:

  • Extreme weather events
  • Natural disasters
  • Governing regulations
  • Port closures
  • Vessel mechanical issues

10. Privacy and Data Protection

Your personal information is managed according to our Privacy Policy. Engaging with our services signifies your approval of the collection and use of your data as outlined in our Privacy Policy.

11. Intellectual Property

Our website content, such as text, imagery, logos, and photos, is protected by copyright and trademark laws. Unauthorized reproduction, distribution, or derivative creation is prohibited without our explicit consent.

12. Governing Law

The laws of France dictate the enforcement of these Terms, and any disputes will be settled in the courts of Nice, France.
